BackgroundMoral case deliberation as a form of clinical ethics support is usually implemented in health care institutions and educational programs. While there is no previous research on the use of clinical ethics support on the level of health care regulation, employees of regulatory bodies are regularly confronted with moral challenges. This pilot study describes and evaluates the use of MCD at the Dutch Health Care Inspectorate.The objective of this pilot study is to investigate: 1) the current way of dealing with (...) moral issues at the IGZ; 2) experience with and evaluation of MCD as clinical ethics support, and 3) future preferences and needs regarding clinical ethics support for dealing with moral questions at the IGZ.MethodsWe performed an explorative pilot study. The research questions were assessed by means of: 1) interviews with MCD participants during four focus groups; and 2) interviews with six key stakeholders at the IGZ. De qualitative data is illustrated by data from questionnaires on MCD outcomes, perspective taking and MCD evaluation.ResultsProfessionals do not always recognize moral issues. Employees report a need for regular and structured moral support in health care regulation. The MCD meetings are evaluated positively. The most important outcomes of MCD are feeling secure and learning from others. Additional support is needed to successfully implement MCD at the Inspectorate.ConclusionWe conclude that the respondents perceive moral case deliberation as a useful form of clinical ethics support for dealing with moral questions and issues in health care regulation. There is an increasing body of research on what kind of ethical challenges health care professionals experience regarding the quality of care. In the Netherlands the Dutch Health Care Inspectorate is responsible for monitoring and regulating the quality of health care. No research exists on what kind of ethical challenges inspectors experience during the regulation process itself. In a pilot study we used moral case deliberation as method in order to reflect upon inspectors’ ethical challenges. The objective of this paper (...) is to give an overview of the ethical challenges which health care inspectors encounter in their daily work. A thematic qualitative analysis was performed on cases that were collected from health care inspectors in a moral case deliberation pilot study. Eight themes were identified in health care regulation. These can be divided in two categories: work content and internal collaboration. The work of the health care inspectorate is morally loaded and our recommendation is that some form of ethics support is provided for health care inspectors. (shrink)

We will use some elements from Ricoeur’s work to examine our view critically and develop it further. This paper presents the main aspects of the proto-Wenzi’s philosophy, with a focus on its intricate relationship with the Laozi. They show that the proto-Wenzi advocates a philosophy of quietude, not only in terms of its content, but also through the rhetoric it uses to create a harmonious synthesis of diverse, and at times even incompatible, ideas.

A total of 80 authors working in a variety of scientific disciplines commented on the theoretical model of CLimate, Aggression, and Self-control in Humans. The commentaries cover a wide range of issues, including the logic and assumptions of CLASH, the evidence in support of CLASH, and other possible causes of aggression and violence. Some commentaries also provide data relevant to CLASH. Here we clarify the logic and assumptions of CLASH and discusses its extensions and boundary conditions. We also offer suggestions (...) for future research. Regardless of whether none, some, or all of CLASH is found to be true, we hope it will stimulate future research on the link between climate and human behavior. Early Chinese argumentative texts are full of historical anecdotes. These short accounts of events in Chinese history enhance the appeal of the text, but they also have an important rhetorical function in helping the reader understand, accept, and remember the arguments propounded in the text. In this paper I examine the rhetorical function of historical anecdotes in two argumentative texts of the Western Han dynasty (202 BCE-9 CE): Han’s Illustrations of the Odes for Outsiders and The Master of Huainan. These (...) two texts found creative use for anecdotes, namely as illustrations of quotations from canonical sources. Through case studies of several combinations of anecdotes and quotations, I argue that the combinations serve to present the creators of these texts as beacons of knowledge with profound understanding of historical events and canonical literature, and with the necessary skills to fruitfully combine the two. Is er een verschil tussen theologie en filosofie, en zo ja, waarin ligt dat verschil? Dat lijkt me de kern te zijn van de punten die Johan van der Hoeven als commentaar naar voren brengt in zijn zeer sympathieke bespreking van mijn bijdrage aan het cursusboek van de Open Universiteit. Ik zal proberen duidelijk te maken waarom ik denk dat dit de kern is, hoewel hij zelf een andere “hoofdvraag” lijkt te formuleren. Maar eerst twee opmerkingen vooraf.

Today the problem of responsible parenthood is frequently reduced to the question of whether or not a couple actually desires to have a child. In medical circles the same question is reduced even further to a choice between the various forms of medical assistance available to a couple who might desire to have a child, but who have been unsuccessful in their own efforts. As a counterbalance to this narrowing process, it would seem appropriate to ask a number of questions (...) which in fact ought to precede it: Why do we want children in the first place? What are we really looking for in our desire to have children? What does it actually mean to have children?In attempting to answer these questions, our course will be a philosophical one, focusing on the meaning of our actions and the reality which surrounds us. Philosophy is unlikely to uncover new facts in such an investigation; its task is simply to examine the presuppositions present prior to our interpretation of the data that emerge from this. Our answers to the questions surrounding our desire for children and the meaning of parenthood must come prior to the available facts on the matter for the simple reason that it will define the significance that these facts will have for us.The questions frequently raised in ethical, pedagogical and juridical literature concerning the rights of parents and children with respect to one another must also precede our examination of the facts. Rights and obligations always pertain to a specific relationship. Knowledge of such relationships is presumed, therefore, when we go about discussing the rights and obligations of the parties involved. By exploring the presuppositions which make our questioning and understanding of the facts possible, philosophy endeavours to create a space wherein we can look at things differently, a space where new and different possibilities are opened up. While we admit that philosophy is not going to uncover new facts, it will, if it works, produce new possibilities for understanding the facts and give them meaning.In this paper, I would like to begin by offering a description of the love parents feel for their children. In the second section I will attempt to draw some conclusions from this description concerning our desire to have the children we do not yet have. In the final section I will endeavour to situate these conclusions in a somewhat broader context. (shrink)

Can theological virtues be integrated in a secular moral philosophy?In the early days of the revival of virtue ethics (in Germany and France since the beginning of the 20th century, in the Anglophone world since the 19-fifties) the ‘theological’ or ‘Christian virtues’ (faith, hope and charity) played an important role. In contemporary virtue ethics they seem to almost be forgotten outside of theology. The question is asked whether (and if: how) these virtues can be integrated in a secular moral philosophy. (...) This seems at first hand to be very problematic, because of their definition, which states among other things that these virtues are God-given and orientated towards God. However: hypothesizing that religious conceptions are related to general human experiences, it may be worth the effort to try and also interpret these theological virtues in a philosophical theory about what makes a human life flourishing. The suggestion is made that these virtues remind us of the importance of a certain passivity or receptivity and of an transcendental openness of our conceptions of happiness. (shrink)

This commentary seeks to clarify the potential discrepancy between lab-based and field data in the use and effectiveness of punishment to promote cooperation by recommending theory that outlines key differences between the lab and field, such as the shadow of the future and degree of information availability. We also discuss a recent meta-analysis (Balliet et al. 2011) that does not support all conclusions outlined in Guala's target article.

Socialism, utilitarianism and democracy are, according to Nietzsche, secularised versions of Christianity. They have continued the monomaniac onesidedness of the Christian idea of what a human being is and should be, and they have even strengthened this monomania through its ‘immanentisation'. The article shows that this ‘immanentisation' is of crucial importance for Nietzsche's critique of democracy. This critique may suggest that Nietzsche's alternative for the disappeared Christian faith is not only a more radical rupture from the religious past, but also (...) a re-interpretation or recreation of the notion of transcendence implied in that faith.. Worldwide there are substantial differences within and between countries in aggression and violence. Although there are various exceptions, a general rule is that aggression and violence increase as one moves closer to the equator, which suggests the important role of climate differences. While this pattern is robust, theoretical explanations for these large differences in aggression and violence within countries and around the world are lacking. Most extant explanations focus on the influence of average temperature as a factor that triggers aggression, (...) or the notion that warm temperature allows for more social interaction situations in which aggression is likely to unfold. We propose a new model, CLimate, Aggression, and Self-control in Humans, that helps us to understand differences within and between countries in aggression and violence in terms of differences in climate. Lower temperatures, and especially larger degrees of seasonal variation in climate, call for individuals and groups to adopt a slower life history strategy, a greater focus on the future, and a stronger focus on self-control. The CLASH model further outlines that slow life strategy, future orientation, and strong self-control are important determinants of inhibiting aggression and violence. We also discuss how CLASH differs from other recently developed models that emphasize climate differences for understanding conflict. We conclude by discussing the theoretical and societal importance of climate in shaping individual and societal differences in aggression and violence. (shrink)

This paper aims to reconstruct the politico-philosophical content of the Ancient Wenzi, according to three interrelated questions: How does the text communicate its views to the reader? What are its main ideas? When and where were these ideas first put to writing? Accordingly, after a discussion of preliminaria in section 1, section 2 focuses on the rhetorical devices in the text, section 3 on its key terms, and section 4 on its possible historical context. The goal of this paper is (...) not only to describe the content of the Ancient Wenzi, but also to contextualize it. That is, to explore the debate to which the Ancient Wenzi may have responded. This article analyzes Mencius 7B.23, a concise passage that offers complex ethical dilemmas. It provides a close reading of the passage, along with relevant passages elsewhere in the text and, occasionally, in other texts. The narrow goal of the article is to present a coherent reading of the passage within the context of the Mencius as a whole. This reading suggests that while the passage touches upon a wide range of topics, including personal credibility and political responsibility, the overarching concern (...) is on being a morally superior person, on the difficult dilemmas such people may face, and on how they would respond to them. More broadly, the article shows that while the philosophical practice of "weighing circumstances" (quan 權) allows moral agents in exceptional cases to break certain moral or ritual rules, Mencius seems unwilling to apply this discretion when morality as a whole, or the integrity of the person who embodies it (shi 士), are involved. The Mozi contains at least three distinct arguments against offensive warfare. The "moral argument" claims that offensive warfare is morally wrong. The "economic argument" calculates that the foreseeable costs of a military campaign inevitably outweigh its possible benefits. The "religious argument" warns that military aggression harms the interests of Heaven. This paper discusses these three lines of argumentation, with extensive reference to the original text in translation. The paper explores what the arguments entail, to whom they may have been addressed, (...) and how persuasive they are from a modern academic perspective. It shows not only how Mozi and his followers theorized about offensive warfare, but also how their arguments were used in practice, at least according to anecdotes in the latter part of the received Mozi. The ultimate goal of this paper is to show how the Mohists actively adapted their argumentative strategies so as to find the best words to end wars. (shrink)

This paper is intended as a gateway to two 2000-year-old manuscripts of the Analects. The first two sections discuss the archaeological context of the discoveries and analyse the manuscripts themselves, including characteristic features of the bamboo strips and the texts inked thereon and notable differences between these and other Analects versions. In these sections, I also critically evaluate present-day Analects studies and offer alternative hypotheses where there is room for debate. The third and final section of the paper discusses what (...) I consider the most fascinating (and most complex) issue regarding the manuscripts: their provenance. In that section, I examine when, where, and why the Analects was copied onto the bamboo strips. The ultimate goal of this paper is to present a nuanced understanding of the two bamboo manuscripts that conveys the fascinating insights they offer while also exploring the limitations of what these manuscripts can actually tell us. Early Chinese thought enjoys a wide appeal, in the scholarly world as much as elsewhere, as people are keen on learning about the ideas of Confucius, Mencius, and other thinkers whose views have shaped traditional Chinese culture. In the study of early Chinese thought, emphasis has long been on what thinkers said, not on how they proffered their views. Even studies that do consider the how, tend to focus on logic and argumentation, rather than rhetoric. Fortunately, in the past few (...) decades growing attention has been paid to Chinese rhetoric which has led to an impressive number of publications.
